THESE TERMS CONSTITUTE A LEGALLY BINDING AGREEMENT BETWEEN YOU ("USER," "YOU," OR "YOUR") AND THE COMPANY. BY ACCESSING OR USING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE OUR SERVICES.
1.1 "Cashback" means the monetary reward or credit offered
to Users for making qualifying purchases through the
Platform's affiliate tracking links at Partner Stores.
1.2 "Partner Store" or "Retailer" means any third-party
e-commerce website or store (including but not limited
to Flipkart, Amazon, Myntra, Ajio, and others) that is
listed on our Platform and has an affiliate partnership
with us directly or through affiliate networks.
1.3 "Affiliate Network" means third-party affiliate tracking
and management platforms (including but not limited to
Cuelinks, Admitad, vCommission, and similar services)
through which we partner with Partner Stores.
1.4 "Tracking Link" means the unique affiliate URL generated
by our Platform that redirects Users to Partner Stores
while enabling tracking of purchases for cashback purposes.
1.5 "FareBack Wallet" or "Wallet" means the virtual cashback
wallet maintained on our Platform that displays your
cashback earnings, pending cashback, and confirmed cashback.
1.6 "Confirmed Cashback" means cashback that has been verified
and confirmed by the Partner Store or Affiliate Network
and is available for withdrawal.
1.7 "Approved Cashback" means cashback that has been tracked
but is awaiting confirmation from the Partner Store or
Affiliate Network.
1.8 "Declined Cashback" means cashback that has been rejected
by the Partner Store or Affiliate Network due to order
cancellation, return, fraud, or other reasons.
1.9 "Minimum Withdrawal Amount" means the minimum balance
of confirmed cashback required in your Wallet to initiate
a withdrawal (currently set at Rs. 00, subject to change).
1.10 "Referral Program" means the program through which
existing Users can invite new Users to the Platform
and earn referral bonuses.(currently not available)
1.11 "Services" means all services provided by FareBack,
including cashback tracking, deal curation, price
comparison, coupon codes, referral programs, and
related features.
2.1 You must be at least 18 years of age to use our Services.
2.2 You must be a resident of India or have a valid Indian
bank account/UPI for cashback withdrawals.
2.3 You must have the legal capacity to enter into a binding
agreement.
2.4 You must not have been previously suspended or banned
from our Platform.
2.5 You may register only ONE account per person. Multiple
accounts per individual are strictly prohibited.
2.6 Business entities may use our Services for business
purchases, subject to these Terms.
3.1 To use cashback features, you must create an account
by providing accurate and complete information.
3.2 You are responsible for:
a) Maintaining the confidentiality of your login credentials
b) All activities that occur under your account
c) Notifying us immediately of any unauthorized use
d) Keeping your account information updated
3.3 We reserve the right to:
a) Suspend or terminate accounts that violate these Terms
b) Refuse registration to any person for any reason
c) Require verification of identity or information
d) Merge duplicate accounts
3.4 You must not:
a) Create accounts using false or misleading information
b) Create multiple accounts to exploit cashback offers
c) Share your account credentials with others
d) Use automated tools to create accounts
e) Impersonate another person or entity
4.1 Overview:
FareBack is a cashback and rewards platform. We earn affiliate commissions when you shop at Partner Stores through our Tracking Links. We share a portion of this commission with you as "Cashback."
4.2 Process:
a) You log into your FareBack account
b) You browse deals/stores on our Platform
c) You click on a Tracking Link to visit a Partner Store
d) You make a purchase on the Partner Store
e) The purchase is tracked by the Affiliate Network
f) Cashback appears as "Pending" in your Wallet
g) After the Partner Store confirms the transaction (typically 30-90 days), cashback becomes "Confirmed"
h) You can withdraw Confirmed Cashback to your bank account via UPI
4.3 Important Conditions for Cashback:
a) You MUST click the Tracking Link on our Platform
BEFORE making a purchase. Purchases made without
clicking our Tracking Link will NOT be tracked.
b) You must complete the purchase in the SAME browser session.
If you close the browser or visit other
cashback sites before completing the purchase,
tracking may fail.
c) Cashback is NOT guaranteed.
It depends on successful
tracking by the Affiliate Network and confirmation
by the Partner Store.
d) The following may cause cashback to NOT be tracked:
Ad blockers or privacy extensions blocking cookies Using incognito/private browsing mode Clicking cashback links from multiple cashback sites Using coupon codes not listed on our Platform Clearing cookies before completing purchase Making purchases through the Partner Store's app (unless specifically supported)
Network connectivity issues during redirect e) Cashback rates displayed on our Platform are approximate and subject to change without prior notice.
Actual cashback may vary based on product category
and Partner Store policies.
f) Cashback is calculated on the net purchase amount
(excluding taxes, shipping charges, gift wrapping,
and other fees) unless explicitly stated otherwise.
5.1 Tracking:
a) After a purchase, cashback typically appears as "Pending" in your Wallet within 24-72 hours.
b) If cashback does not appear within 72 hours, you may raise a "Missing Cashback" claim.
c) Missing Cashback claims must be filed within 30 days of the purchase.
5.2 Confirmation:
a) Pending cashback is confirmed by the Partner Store or Affiliate Network, NOT by FareBack.
b) Confirmation typically takes 30-90 days from the date of purchase.
c) Some categories or stores may take up to 120 days for confirmation.
d) FareBack has NO control over the confirmation timeline or decision.
5.3 Decline/Rejection:
Cashback may be declined due to:
a) Order cancellation or return by the User
b) Partial return of order items
c) Use of unauthorized coupon codes
d) Fraudulent or suspicious activity detected by the Partner Store
e) Violation of Partner Store's terms and conditions
f) Technical tracking failure
g) Partner Store's decision (which is final)
h) Bulk or commercial purchases
i) Purchase using gift cards or store credits (some stores)
5.4 FareBack's Liability:
a) We act as an INTERMEDIARY between you and the Partner Stores/Affiliate Networks.
b) We rely on data provided by Affiliate Networks for cashback tracking and confirmation.
c) We are NOT liable for cashback that is not tracked due to technical issues, cookie blocking, or Affiliate Network failures.
d) We are NOT liable for cashback rejected by Partner Stores or Affiliate Networks.
e) Our maximum liability for any cashback dispute shall not exceed the amount of cashback in question.
6.1 Minimum Withdrawal:
a) The minimum withdrawal amount is Rs. 00 (subject to change without notice).
b) Only Confirmed Cashback can be withdrawn.
c) Pending Cashback cannot be withdrawn.
6.2 Withdrawal Methods:
a) UPI (Google Pay, PhonePe, Paytm, etc.)
b) Other methods as made available from time to time
6.3 Processing Time:
a) Withdrawal requests are processed within 3-7 business days.
b) Bank processing times may add 1-3 additional business days.
c) We are not responsible for delays caused by banks or payment processors.
6.4 Taxes:
a) Cashback earnings may be subject to applicable taxes under Indian tax laws.
b) If your total cashback earnings exceed Rs. 5,000 in a financial year, TDS may be applicable as per Section 194R or other applicable provisions of the Income Tax Act, 1961.
c) You are solely responsible for reporting and paying any taxes on cashback earnings.
d) We may require your PAN card details for tax compliance purposes.
6.5 Forfeiture:
a) If your account is terminated due to violation of these Terms, all pending and confirmed cashback may be forfeited.
b) Cashback earned through fraudulent means will be forfeited.
c) If an account is inactive for 12 consecutive months, the cashback balance may be forfeited after notice.

8.1 You agree NOT to:
a) Create multiple accounts or use fake identities
b) Use automated tools, bots, or scripts to interact with our Platform
c) Manipulate cashback tracking through cookie stuffing, click fraud, or other deceptive methods
d) Make purchases solely for the purpose of earning cashback and then returning the products
e) Use our Platform for any illegal or unauthorized purpose
f) Attempt to hack, reverse-engineer, or disrupt our Platform
g) Scrape, crawl, or extract data from our Platform without authorization
h) Post or transmit malicious code, viruses, or harmful content
i) Harass, abuse, or threaten other Users or our staff
j) Circumvent any security measures on our Platform
k) Use our Platform to compete with us or build a competing service
l) Misrepresent your identity or affiliation
m) Engage in any activity that violates applicable laws
n) Share or publish private information of other Users
o) Use our trademarks, logos, or content without written permission
p) Artificially inflate cashback through fake or manipulated transactions
q) Use coupon codes from other cashback platforms in conjunction with our tracking links to manipulate commissions
9.1 Our Intellectual Property:
a) The FareBack name, logo, brand, and all associated trademarks are the exclusive property of the Company
b) All content on our Platform, including text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is our property or licensed to us
c) The design, layout, and look-and-feel of our Platform are protected by intellectual property laws
d) Our proprietary algorithms, cashback calculation methods, and tracking systems are trade secrets
9.2 Limited License:
a) We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Platform for personal, non-commercial purposes
b) This license does not include:
Modifying or copying our content Using our content for commercial purposes Downloading content (other than page caching) Any resale or commercial use of our Platform Any data mining, scraping, or similar data extraction methods 9.3 Your Content:
a) If you submit reviews, feedback, or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, modify, and display that content
b) You represent that you have the right to submit such content
9.4 Copyright Infringement:
If you believe content on our Platform infringes your copyright, contact us at legal@fareback.in with:
Description of the copyrighted work Location of the infringing material A statement of good faith belief 10.1 OUR PLATFORM AND SERVICES ARE PROVIDED "AS IS" AND
"AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER
EXPRESS OR IMPLIED.
10.2 WE DO NOT WARRANT THAT:
a) The Services will be uninterrupted, timely, secure, or error-free
b) Cashback will always be tracked successfully
c) Cashback rates displayed will always be accurate
d) Partner Stores will honor all cashback transactions
e) The Platform will be free of viruses or harmful components
f) Any errors will be corrected
g) The results obtained from using the Services will be accurate or reliable
10.3 WE DO NOT ENDORSE OR GUARANTEE:
a) Any products or services offered by Partner Stores
b) The quality, safety, or legality of products purchased through our Tracking Links
c) The accuracy of product descriptions or prices on Partner Store websites
d) The delivery or fulfillment of orders by Partner Stores
10.4 Cashback rates, offers, and deals are subject to
change without notice and may vary based on:
a) Partner Store policies
b) Affiliate Network terms
c) Product categories
d) Promotional periods
e) Our business decisions
11.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW,
FAREBACK AND ITS DIRECTORS, OFFICERS, EMPLOYEES,
AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:
a) Any indirect, incidental, special, consequential, or punitive damages
b) Loss of profits, data, goodwill, or other intangible losses
c) Any damages arising from:
Your use or inability to use our Services Untracked or declined cashback Unauthorized access to your account Actions of Partner Stores or Affiliate Networks Technical failures or downtime Third-party content or services Any errors or omissions in our content 11.2 OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING
FROM OR RELATED TO THESE TERMS OR YOUR USE OF OUR
SERVICES SHALL NOT EXCEED THE TOTAL CASHBACK CREDITED
TO YOUR ACCOUNT IN THE 12 MONTHS PRECEDING THE CLAIM,
OR Rs. 5,000, WHICHEVER IS LOWER.
11.3 SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED
WARRANTIES OR EXCLUSION OF CERTAIN DAMAGES. IN SUCH
CASES, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
12.1 You agree to indemnify, defend, and hold harmless
FareBack and its directors, officers, employees,
agents, and affiliates from and against any and all
claims, damages, losses, liabilities, costs, and
expenses (including reasonable attorneys' fees)
arising from or related to:
a) Your use of our Services
b) Your violation of these Terms
c) Your violation of any applicable law or regulation
d) Your violation of any third-party rights
e) Any content you submit or post on our Platform
f) Fraudulent or illegal activity on your account
g) Any misrepresentation by you
13.1 Our Platform contains links to Partner Stores and
other third-party websites. These links are provided
for your convenience only.
13.2 We do NOT:
a) Control or endorse any third-party website
b) Assume responsibility for their content, privacy policies, or practices
c) Guarantee the availability of products on Partner Stores
d) Guarantee the accuracy of prices or offers on Partner Stores
13.3 Your transactions with Partner Stores are solely
between you and the Partner Store. Any issues
regarding products, delivery, refunds, or customer
service should be directed to the Partner Store.
13.4 We are not a party to any transaction between you
and the Partner Store. We are solely a marketing
affiliate that earns commissions and shares them
with you.
14.1 Governing Law:
These Terms shall be governed by and construed in accordance with the laws of India.
14.2 Jurisdiction:
Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Rajasthan and West Bengal, India.
14.3 Dispute Resolution Process:
a) Step 1: Contact our customer support at support@fareback.in. We will try to resolve the issue within 15 business days.
b) Step 2: If not resolved, escalate to our Admin at admin@fareback.in. The Admin will respond within 30 days.
c) Step 3: If still not resolved, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.
d) Arbitration shall be conducted by a sole arbitrator appointed mutually, in Rajasthan, India, in English language.
14.4 Class Action Waiver:
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
15.1 By You:
a) You may terminate your account at any time by contacting us at support@fareback.in
b) Before termination, you should withdraw any Confirmed Cashback balance
c) Pending Cashback will be forfeited upon termination
15.2 By Us:
We may suspend or terminate your account:
a) For violation of these Terms
b) For fraudulent or suspicious activity
c) For inactivity exceeding 12 months
d) If required by law
e) At our sole discretion with reasonable notice
15.3 Effect of Termination:
a) Access to your account will be revoked
b) Pending Cashback will be forfeited
c) Confirmed Cashback may be paid out within 30 days
(subject to fraud verification)
d) Provisions that should survive termination
(including Intellectual Property, Limitation of
Liability, Indemnification, and Dispute Resolution)
shall survive
16.1 We reserve the right to modify these Terms at any time.
16.2 Material changes will be notified through:
a) Email to your registered email address
b) Prominent notice on our Platform
c) Pop-up notification upon login
16.3 Continued use of our Services after notification
constitutes acceptance of modified Terms.
16.4 If you disagree with modified Terms, you must stop
using our Services and terminate your account.
17.1 Entire Agreement:
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and FareBack regarding the use of our Services.
17.2 Severability:
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
17.3 Waiver:
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
17.4 Assignment:
You may not assign or transfer these Terms or your account without our written consent. We may assign our rights under these Terms without your consent.
17.5 Force Majeure:
We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, wars, pandemics, government actions, internet outages, power failures, or Affiliate Network outages.
17.6 No Agency:
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and FareBack.
17.7 Notices:
a) Notices to you will be sent to your registered email address
b) Notices to us should be sent to legal@fareback.in
17.8 Language:
These Terms are drafted in English. In case of any translation, the English version shall prevail.
18.1 We take fraud very seriously. The following activities
are considered fraud:
a) Creating multiple accounts to earn cashback/referral bonuses multiple times
b) Using automated tools or bots
c) Cookie stuffing or click manipulation
d) Making purchases with the primary intent of earning cashback and then returning products
e) Using stolen credit cards or payment methods
f) Colluding with Partner Store employees for fake transactions
g) Exploiting technical glitches in cashback rates
h) Any activity designed to earn cashback dishonestly
18.2 Consequences of Fraud:
a) Immediate account suspension or termination
b) Forfeiture of all cashback (pending and confirmed)
c) Recovery of previously paid cashback
d) Reporting to law enforcement authorities
e) Legal action including civil and criminal proceedings
f) Permanent ban from the Platform
18.3 Detection:
We use automated fraud detection systems and manual reviews. Our fraud detection decision is final and binding.
19.1 FareBack does NOT guarantee cashback on any purchase.
19.2 Cashback is dependent on successful tracking by
Affiliate Networks and confirmation by Partner Stores,
both of which are beyond our control.
19.3 The cashback rates displayed on our Platform are
indicative and may vary. Actual cashback may be
different from the displayed rate.
19.4 We shall not be liable for any cashback claims if
the Affiliate Network or Partner Store does not
confirm the transaction.
19.5 In cases where cashback is not tracked due to
technical issues, we will make reasonable efforts
to recover the cashback from the Affiliate Network,
but we do not guarantee recovery.
20.1 Each Partner Store may have specific terms and
conditions for cashback. These may include:
a) Excluded product categories
b) Maximum cashback caps
c) Minimum order value requirements
d) Specific coupon code restrictions
e) New customer vs returning customer rates
20.2 It is your responsibility to review store-specific
terms displayed on our Platform before making a
purchase.
20.3 Partner Store terms may override general cashback
terms.
21.1 By registering on our Platform, you consent to
receive communications from us via:
a) Email
b) Push notifications
c) WhatsApp (if you provide your number)
d) In-app notifications
21.2 Types of communications:
a) Transactional (cashback updates, withdrawal confirmations) - cannot be opted out
b) Promotional (deals, offers, newsletters) -can be opted out
